Pesky watches your competitors so you don't have to. These are the terms for using it. Plain English, no traps. If something here is unclear, email ruz@pesky.ai and a human answers.
1. Who we are
Pesky is made by Pesky OÜ, a private limited company registered in Estonia (“Pesky”, “we”, “us”). These terms are a contract between you and Pesky OÜ. By using pesky.ai, the free scan, a plan, the API, or the MCP server, you agree to them.
2. What Pesky does
You give Pesky a website. Pesky looks at public information about that website and about other companies on the public web, and tells you which of them look like competitors, clones, or emerging threats. On a paid plan it keeps doing that every day and sends you what changed.
Pesky reads public pages and public sources only. It does not log into anything on your behalf and it does not access anyone's private systems.
3. The free scan
Anyone can run the free scan at pesky.ai or open a scan link such as pesky.ai/@yourdomain.com. It is rate-limited per visitor. Results are kept for a week so a shared link shows the same card to everyone. The free scan is provided as is, for you to look at and share; see section 7 on accuracy.
4. Accounts and sign-in
Some features need an account. You can sign in with Google or with an email address. Keep your sign-in to yourself; you are responsible for what happens under your account. You must be at least 16 years old, or the age of digital consent where you live if that is higher, to create one.
5. Plans, payment, cancellation
- Paid plans (IDEA, GROWTH, MOMENTUM, MOMENTUM ×3, RAINMAKER) are billed in advance, monthly or yearly as shown on the pricing tab at the time you subscribe. Prices are in US dollars and exclude VAT where VAT applies.
- Payments are handled by a third-party payment processor. Pesky never sees or stores your full card number.
- You can cancel at any time; the plan runs until the end of the period you paid for and does not renew. Where a free trial is offered, you are not charged until it ends.
- If something we sold you did not work as described, email us within 14 days and we will make it right, which can include a refund.
- We may change prices with at least 30 days' notice by email. A price change never applies to a period you have already paid for.
6. Fair use
Use Pesky to understand your market. Do not use it to harass a company or a person, to scrape Pesky itself, to resell Pesky's output as your own service, to get around the rate limits, or for anything illegal. Seats and companies on a plan are for your own organisation. We may suspend an account that breaks these rules, and we will tell you why.
7. Accuracy, and what we don't promise
Pesky combines public data with AI models to name competitors and explain why. That is a judgement, and judgements are sometimes wrong. A name on a card is a lead to check, not a verdict. Domain-authority scores come from third-party data and are shown as we receive them. Pesky is provided as is and as available. We do not promise it will be uninterrupted, error-free, or right about your market.
8. Your data and ours
The website you scan, the results, and anything you type stay yours. You give Pesky a licence to process them to provide the service, including generating and caching result cards and the pictures of them. The Pesky name, marks, illustrations, the game, the copy, and the code are ours; you may share result cards and pictures freely, and you may not copy the rest without permission. How we handle personal data is in the Privacy Policy.
9. API and MCP
Plans from IDEA up include access to the Pesky API and MCP server for your own use. Keep your keys secret, respect the rate limits published with the API, and do not build a competing competitor-monitoring service on top of them. We may change or retire API features with reasonable notice.
10. Liability
To the extent the law allows, Pesky OÜ is not liable for indirect or consequential losses, lost profits, or decisions you make based on Pesky's output. Our total liability to you for anything arising from the service is limited to the amount you paid Pesky in the twelve months before the claim, or 100 euros if you paid nothing. Nothing here limits liability that cannot be limited by law.
11. Changes and ending
We may update these terms. If a change matters, we will email account holders before it takes effect, and the date at the top will move. Keep using Pesky after that date and the new terms apply. You can stop using Pesky and delete your account at any time by emailing us; we can end the service with 30 days' notice, or immediately if you break section 6.
12. Law and disputes
These terms are governed by the laws of Estonia. Disputes go to the courts of Tallinn, Estonia, unless the law where you live gives you the right to bring them at home. Consumers in the EU can also use the European Commission's online dispute resolution platform.
